The Premium Practices Forecast 2013 published by BTI Consulting Group has stated that corporate
spending on outside IP counseling will rise by 2.4% in 2013 and spending on IP litigation will rise by 3.1%
in 2013. The 2013 forecast is based on 240 interviews with general counsel and other counsel at top-
spending companies conducted between March 22, 2012 and September 12, 2012.

The report cites a number of reasons for the uptick in IP work including, the increasing realization of the
value of intellectual property; the growth in technology based companies; the growth of non-practicing
entities; the Leahy-Smith America Invents Act; and increasing concerns about global protection of IP
assets. This means that companies, large and small, not only anticipate protecting and enforcing their IP
assets, but also vigorously defending against IP enforcement efforts.
