Since the Apple v. Samsung litigation, we have had many clients inquire about filing of a design patent. A design patent, which covers the ornamental aspects of an invention, usually takes a back seat to the common utility patent. Apple, however, prevailed on a design patent for an electronic product that had few ornamental aspect, showing that design patents can be valuable in protecting a product. Many of our clients have started to focus on design patents as an additional avenue to protect their products.
