How the AIA Brings Americans Together: Crowdsourcing Patent Validity Challenges
In a move that is sure to shake up the world, U.S. Patent and Trademark Office, Google and Stack Exchange, a web based community of software engineers have teamed up to make an innovative use of the USPTO’s new procedures allowing for third-party challenges to the validity of patents.
A website, patents.stackexchange.com, has been created where users can submit their patents for review or find a list of patents that others have submitted for review. It is then up to the users to find prior art, discuss the validity of the identified patents, and submit any evidence directly to the USPTO with one click. This website is the reaction of the software engineering community to the increasing number of patent infringement battles over software patents, which the programmers feel are stifling innovation. This website has the potential to shake up the patent landscape due to the sheer power of having thousands and perhaps millions of people coming together to invalidate patents.
